Eligibility to participate Any individual or company who is an Income Tax Assessee may participate. Obtaining of Tender forms: MML will not be held responsible for delay in submitting the completed tender documents by the foreign / inland buyers. No extension of time for the submission of tenders will be allowed on this score and on any count. Tender forms completed in all respects separately for each quarry should be submitted in a sealed cover superscribing TENDERS FOR THE SALE OF ROUGH GRANITE BLOCKS and addressed to The Chairman and Managing Director, Mysore Minerals Limited, No.39, M.G.Road, Bangalore-560 001 shall be dropped in tender box kept at reception for the purpose or by post so as to reach on or before 12.00 Hrs. on 6th November,2006. at the registered office of the Company. The tender should furnish all details in the application form given in Annexure 2 with supporting documents. The tenderers should quote their rate in the format given at Annexure-3 separately for each quarry along with EMD of Rs.25,000/- drawn in favour of Mysore Minerals Limited payable at Bangalore. The rate quoted is ex-quarry and excluding royalty, loading charges, taxes etc. The rate quoted shall be for entire lot of each quarry. The EMD amount of Rs.25,000/- of the successful tenderer will be converted and adjsuted towards security deposit. The successful bidder shall pay 25% of the bid amount as sale advance within three working days from the date of awarding the tender. The balance 75% bid amount to be paid within 15 days from the date of awarding the tender. If the successful bidder fails to deposit 25% of the bid amount within three working days from the date of sale award, MML reserves the right to allot the material to the next highest bidder. The EMD amount of Rs.25,000/- will be forfeited. The sale advance to be paid through DD drawn in favour of Mysore Minerals Limited and payable at Bangalore.In case of breach of contract by the tenderer the security deposit and the full sale advance (25% and 75%) will be forfeited . MML reserves the right to award the entire lot to the next highest bidder who fulfils all the terms and conditions including tender criteria cited at Sl.No.13. After successful completion of the contract the security deposit will be refunded. The security deposit will not carry any interest. In case of any differences, litigations arising out of any dispute, the expenses incurred by MML in this regard will be deducted from the security deposit of the party. The rough granite blocks will be delivered only on receipt of full amount along with payment of royalty, FDT, cess, loading charges and applicable taxes extra. Period of Agreement: The agreement shall be in force for a period of three months from the date of awarding of tender. Indemnity: The successful tenderer shall undertake to indemnify the company against any action or proceedings, cost or claims, loss or damage to which the company may be exposed to as a result of any act of omission or commission by the tenderer. Force Majure Clause: Criteria to consider tender offer: Financial capability of the tenderer The Chairman and Managing Director, MML reserves the right to cancel the bid The Chairman and Managing Director reserves right to modify or alter the terms and conditions of the tender. If the successful tenderer has got any trade representative, the said representative will be utilised only for the purpose of trading activity and NOT as the representative of the successful tenderer in the arbitration proceedings or in the court proceedings or in respect of any matter other than the act of mere representative in the inspection of materials and other allied subjects and the said agent will not have any right to represent the tenderer either to commence or to continue or to participate in any dispute or litigation that may arise between the tenderer and MML.
